These Terms are the agreement between you and Onrois ("we", "us"), 707, Kyros Business Center, Sarathana, Surat, Gujarat, India, covering the Perfekt mobile app, this website, and anything we serve through them (the "Service").

By downloading, opening or using Perfekt you accept these Terms. If you do not accept them, do not use the Service. Our Privacy Policy is part of this agreement and explains what happens to the photos you edit.

02Who can use Perfekt

You must be at least 13 years old. If you are under 18, you may use Perfekt only with the consent of a parent or guardian, who accepts these Terms on your behalf and is responsible for any purchases you make.

You must also be legally permitted to use the Service where you live, and not barred from it under any sanctions or trade rules that apply to us.

03No account, just a support code

Perfekt has no sign-up. Your install carries a random identifier and a short support code, shown on your profile tab, which is how we find your edits and credits if you write to us.

Because your credits are tied to that install, deleting the app, resetting your device or moving to a new phone can lose an unused balance. Note your support code somewhere before you do any of those, and we will do what we can to restore it.

04Credits, subscriptions and refunds

Editing consumes credits. Credits are bought through the Apple App Store or Google Play, and subscriptions renew automatically until you cancel them in your store account — not with us, because we cannot cancel them for you.

Credits are a limited licence to use the Service. They have no cash value, cannot be transferred or sold, and expire if we discontinue the Service as described in section 10.
Prices can change. A change never applies to credits you have already bought, and we will tell you before a subscription renews at a new price.
Refunds are handled by Apple and Google under their own policies, since they take the payment. If a failed edit consumed credits through our fault, write to us with your support code and we will restore them.
Statutory refund and cancellation rights that apply where you live are not affected by anything in this section.

05Your photos and the permission you give us

Your photos stay yours. So do the edits we return — we claim no ownership over either.

To make an edit at all, we need your permission to move the file around. So you grant us a limited, worldwide, royalty-free licence to store, transmit and process the photo you select — and to pass it to the third-party AI providers named in our Privacy Policy, currently OpenAI and xAI (Grok) — for the sole purpose of producing the edit you asked for and delivering it back to you. That licence covers nothing else. It ends when the file is deleted, within 30 days.

We will not use your photos to train AI models, will not publish them, and will not use them to promote Perfekt unless you separately and explicitly agree. The AI providers we send them to are bound by API terms that likewise prohibit training on them.

You confirm that you own or are licensed to use every photo you upload, and that editing it does not infringe anyone else's rights.

06What you may not upload or do

Do not use Perfekt to create or process:

Sexual content involving minors, in any form. This is reported to the authorities, always.
Intimate or sexual imagery of any real person without their consent.
Images made to impersonate a real person, forge a document or identity, or deceive someone into believing something false about them.
Content that harasses, threatens, defames or incites violence or hatred against anyone.
Anyone else's copyrighted or trademarked work that you have no right to use.
Anything else illegal where you are, or where we operate.

You also agree not to reverse-engineer the Service, extract or resell our presets, script or automate access to it, work around credit limits, or attack the infrastructure it runs on.

We may screen uploads automatically for the categories above. If you post an edit publicly, say that it was AI-edited where it might otherwise mislead someone.

07What AI editing does and does not promise

Perfekt edits your photo with AI models. That means the result is a probabilistic output, not a deterministic one: the same photo and the same preset can produce different results, and an edit can be imperfect, unflattering or plainly wrong.

Check an edit before you rely on it. Do not use Perfekt output as evidence, as a record of something that happened, or in any setting where an altered image could mislead. You are responsible for what you do with an edit once we hand it back.

Because outputs are generated, we cannot promise that any given result is unique, and other users may receive similar results from similar inputs.

08What belongs to us

The app, this website, the Perfekt name and logo, the preset library and the recipes behind it are ours or our licensors', and are protected by copyright and trade-mark law. These Terms give you a personal, non-transferable, revocable licence to use the Service — nothing more.

If you send us feedback or a suggestion, we may act on it freely and without owing you anything for it.

09Beta and early features

Parts of Perfekt ship as beta. Beta features may be unstable, may change without notice, and may be withdrawn. Anything labelled beta is explicitly excluded from the already-limited assurances in section 11.

10Suspension, termination, and changes to the Service

You can stop using Perfekt at any time by deleting it. Cancel any subscription in your store account first — deleting the app does not cancel it.

We may suspend or end your access if you break these Terms, if we are required to by law, or if your use threatens the Service or other users. Where the reason is not serious or urgent, we will warn you first and give you a chance to put it right.

We may change, limit or discontinue features, and could one day retire the Service entirely. If we retire it, we will give reasonable notice in the app and refund any unused credits you paid for, to the extent the app stores allow.

11No warranty

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free or secure, that any edit will meet your expectations, or that files will never be lost. Keep your own copy of anything you care about.

Some jurisdictions do not allow these exclusions. Where that is the case, they do not apply to you, and any warranty implied by law is limited to the shortest period that law permits.

12Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data or lost images, however caused.

Our total liability for all claims relating to the Service is capped at the greater of (a) what you paid us in the twelve months before the claim, or (b) USD 100.

Nothing here excludes liability that cannot be excluded by law — including for death or personal injury caused by negligence, for fraud, or under consumer protection rules that apply to you regardless of what a contract says.

13Indemnity

If someone brings a claim against us because of a photo you uploaded or a use of the Service that broke section 06, you agree to cover our reasonable losses and legal costs arising from it.

14Changes to these Terms

We may update these Terms. The date at the top always reflects the current version. For material changes we will give at least 30 days' notice in the app or on this page before they take effect, and continuing to use Perfekt after that means you accept them. If you do not, stop using the Service and cancel any subscription.

15Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts at Surat, Gujarat, India have exclusive jurisdiction, except where the consumer law of your own country gives you the right to sue locally — in which case that right stands.

Before filing anything, email us at [email protected]. Most complaints are faster to fix than to litigate, and we would rather fix them.

16Odds and ends

Severability. If a clause is unenforceable, it is trimmed to the minimum that works and the rest stands.
Waiver. Not enforcing a term once does not mean we have given it up.
Assignment. You may not transfer this agreement. We may, as part of a merger or sale, on notice to you.
App store rules. Apple and Google have their own terms for the store you downloaded from, and those apply alongside these. Apple and Google are not responsible for Perfekt and have no obligation to support it.
Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.
